Terms and Conditions (T&Cs)

1. Porta mundi AG (hereinafter referred to as ‘porta mundi’) aims to help its students in all subjects and at all levels to add depth to and acquire new expertise in the topics covered, as well as to overcome exam nerves and develop various learning strategies. Our coaching services are based in particular on the students being taught at home by competent teachers and on working closely with all parents. These coaching services take place by appointment either at our premises or online as a video conference. In addition to individual coaching sessions, porta mundi offers group courses and simulation exams by arrangement.
   
2. These terms and conditions, together with the individual agreement, govern the contractual relationship between the parents (‘parents’) and porta mundi – ‘together’, the ‘parties’ – for the provision of the aforementioned coaching services. If the student is over 18 years old and the contract is agreed directly with him/her, these T&Cs (also) apply to him/her.

1. The coaching is based on the curriculum applicable to the agreed subject and the materials used in class. As part of the coaching, the materials are gener-ally provided by Porta Mundi. If necessary and after consultation with the Porta Mundi teacher, additional materials will be purchased, which are to be paid for by the parents or students.
   
2. Porta Mundi determines the teachers to be used for the coaching at its own discretion. However, Porta Mundi takes the wishes of the parents into account.
   
3. The scope of services corresponds to the number of coaching hours booked. In addition, Porta Mundi offers up to one telephone conversation per month to discuss general performance, extraordinary conversations as needed, and a short written report at the end of the semester on performance and the achievement of the set goals, including an outlook for the student.
   
4. Porta Mundi does not guarantee that a specific learning outcome will be achieved. Within the legal limits, any contractual and non-contractual liability on the part of Porta Mundi and its organs, employees, and auxiliary persons is also excluded in full.

1. The location and time of the coaching sessions are agreed between the parties.
   
2. If the student is unable to attend a coaching session, the parents are obliged to inform Porta Mundi at least one day in advance by email, text message, or telephone. If the parents cancel a coaching session less than 24 hours in advance, they owe Porta Mundi the price of one lesson (60 minutes).
   
3. If the lesson is canceled less than two hours in advance, the parents owe Porta Mundi the price for the agreed coaching time (the same applies if the student does not show up for the agreed appointment).
   
4. If the parents can demonstrate that it was not possible to provide early notification under the circumstances, Porta Mundi will endeavor to reach a mutual agreement with the parents without obligation and without waiving its legal claims.
   
5. If the student cancels or postpones a coaching appointment with the teacher, we will only make the change with the parents' consent.
   
6. Porta Mundi reserves the right to cancel or postpone a coaching appointment at short notice.

1. Porta mundi prepares a registration form for the coaching with the applicable conditions and sends it to the parents. The contract for the coaching becomes binding when the parents return the signed registration form to porta mundi in due time.
   
2. The number and length of lessons originally agreed can be shortened or extended on an ongoing basis by mutual agreement.

1. The prices listed on our website (www.portamundi.org) at the time of conclusion of the contract, which were listed in a confirmation email to the parents for the coaching of the individual student, apply.
   
2. The price range for remedial and support lessons varies depending on the level of education, long-term nature, and intensity of support, and the prices for preparatory courses depend on the size of the group.
   
3. The prices for our services are based on a 60-minute lesson.
   
4. In addition to the price of the coaching, the teacher's travel expenses of CHF 10.00 per meeting will be charged if the lessons take place at home and not online.
   
5. On Sundays and public holidays, one and a half times the price will be charged.
   
6. (6) At the beginning of the month following the coaching sessions in question, Porta Mundi will send parents an invoice for the entire month by email (unless otherwise agreed). Porta Mundi may make the provision of coaching sessions dependent on advance payment by the parents at any time.
   
7. For courses with a total price of CHF 2,000.00 or more, the option of payment in installments is offered. Payment can be made in two, three, or five equal installments. Different installment payments are possible after individual consultation with the course provider. A one-time processing fee of CHF 50.00 will be charged for the use of installment payments, which is due with the first installment. The due date for each installment is specified in the respective course confirmation.

1. Swiss substantive law applies to the contract between Porta Mundi and the parents. All disputes arising from or in connection with the contract, including those concerning its valid conclusion, legal effect, amendment, or termination, shall be settled by the ordinary courts at the registered office of Porta Mundi.

1. Porta Mundi has the right to revise and unilaterally amend the GTC at any time within the legal limits.

1. Should one or more provisions of the General Terms and Conditions be invalid, either initially or at a later date, this shall not affect the validity of the remaining provisions. In this case, a valid provision that comes closest to the legal and economic purpose shall be deemed to have been agreed.
